First, if that clerk did not have an infantry MOS or had been functioning as an infantryman for over 30 days that CIB was fraudulent.  I know there were a lot of them out there but I had one rescinded for a supply sergeant in C Co, 2/503.  He said someone had told him that because he was assigned to a rifle company he was authorized it.  I knew of a few others but was not in  a position to affect those.  
As for company clerks, we had a new E-3 company clerk when we deployed to Lebanon in 58.  When I got back to Germany in Oct her was an E-5!  using maximum waivers and his skills he had promoted himself to E-4 and E-5 during our deployment. The CO had been an enlisted Marine in WWII and thought it was funny.  He was so impressed he let the guy keep his rank!

  As was often said "The company clerk is the most powerful person in 
the US military."  If they like you they can do all sorts of write-ups 
for just about anything. On the other hand if they are lazy or just hate 
you in particular you will be lucky to have been recorded to have been 
at that duty station.

  I'm reminded of a company clerk from Nha Trang that was in one of my 
PTSD groups. His claim for PTSD was all of the awards and actions he was 
in. He even had a CIB having never been out in the field because he said 
that "technically" since Nha Trang had attacks going in on and around 
the base during the 68 TET offensive for over 30 days he qualified so he 
did the write up and got the CIB.  We ran his ass out of the PTSD group 
and the Doctor running the group wrote up why he got kicked out.
